St. Casimirs Savings Bank Internet Banking Terms and Conditions Agreement
This Agreement describes your rights and obligations as a user of the On-line Banking Service or the Bill Payment Service ("Service" or "Services"). It also describes the rights and obligations of St. Casimirs Savings Bank. Please read this Agreement carefully. As an authorized account holder you must abide by the terms and conditions of this agreement, and those provided to you at account opening, in order to use this Service.
CUSTOMER DISCLOSURE AND AGREEMENT TO RECEIVE ELECTRONIC COMMUNICATIONS
By selecting the "I Accept" button below, you are (1) acknowledging your receipt of the information listed below, (2) agreeing that any contract you enter into with St. Casimirs Savings Bank for the provision of certain On-line Banking Services, may be in electronic form, and (3) agreeing that certain information that may be delivered in connection with the Services may also be in electronic form.
You are also acknowledging receipt of the following information and agree that:
We may provide you with this Agreement and any revisions and amendments thereto in electronic form, and that, if you choose to accept the Agreement, you are consenting to enter into and are entering into an agreement electronically that will govern all future transaction you conduct using the Service.
We may provide you revisions and amendments to the Agreement and such other information, including but not limited to information under Regulation E and under other applicable banking or financial services laws or regulations in connection with the Service, electronically as a part of the Agreement or otherwise as a part of the Services. While you may print and retain a copy of the Agreement or any information provided to you in relation to the Service, we only provide these documents electronically.
You have a right at any time to withdraw, without service charges, your consent to receive information electronically. However, because the Agreement and the Information are provided only in electronic format, your withdrawal of consent will terminate all the Services.

You are able to access information that is provided in the same manner as the information and the Services via the Internet.
The following definitions apply in this Agreement. "On-line Banking" is the Internet-based service providing access to your account(s) under the terms set forth in this Internet Banking Terms and Conditions Agreement
"On-line Account" is a St. Casimirs Savings Bank account from which you will be conducting transactions using a Service.
"Business Day" refers to Monday through Friday, 7:00 a.m. to 9:00 p.m., excluding holidays as determined by St. Casimirs Savings Bank. All On-line transaction requests received after the Business Day, or on a non-Business Day, will be processed immediately, but will not post to accounts until the following Business Day after checks processed during nightly processing.
"Password" is a series of numbers and/or letters that you select after the initial sign-on, that establishes your connection to the Service. St. Casimirs Savings Bank will provide you with a code for use during the initial sign-on process.
"Payment Initiation Date" is the date you enter into On-line Banking when setting up a bill payment.
"Time of day" references are to Eastern Standard Time.
"We," "us" "our" or "bank" refer to St. Casimirs Savings Bank, which offers the Services provided under this Agreement and holds the accounts accessed by the Services.
ACCESS TO SERVICES
St. Casimirs Savings Bank will provide on-line instructions describing how to use the On-line Banking Service or Bill Payment Service. To gain access to this Service you will need your Access ID and your Password.
ST. CASIMIRS SAVINGS BANK'S PERSONAL ONLINE BANKING SERVICE
St. Casimirs Savings Bank's Personal Online Banking is a consumer electronic banking service. You may access St. Casimirs Savings Bank's Personal Online Banking through St. Casimirs Savings Bank's website on the Internet (www.STCSB.com). When you access St. Casimirs Savings Bank's Personal Online Banking, your instructions may be recorded. You consent to such recording.
ACCESS OF ACCOUNTS
In order to use St. Casimirs Savings Bank's Personal Online Banking and access your accounts, you must have personal deposit or loan accounts with St. Casimirs Savings Bank and your name must appear on a name line as an owner/signer on each such account. You may not perform an online withdrawal or transfer from any account that requires more than one signature to authorize the transaction. Notwithstanding the terms of any of your existing or future agreements with us, any person granted access to St. Casimirs Savings Bank's Personal Online Banking may authorize us to make transactions to and from your accounts.
EQUIPMENT AND TECHNICAL REQUIREMENTS
In order to have access to St. Casimirs Savings Bank's Personal Online Banking, you are required to acquire and maintain, at your own expense, Internet access and an Internet browser with the security and 128-bit encryption level required. We are not responsible for any computer virus or similar problem caused by the use of St. Casimirs Savings Bank's Personal Online Banking.
HOURS OF OPERATION
The Services are generally available 24 hours a day, 7 days a week, except during special maintenance and upgrade periods, which are scheduled between 12:00 am Wednesday to 6:00 am Thursday, and 12:00 am Sunday to 6:00 am Monday.
USE OF YOUR SECURITY PASSWORD
The safety of our customers' accounts and account information is of paramount importance to St. Casimirs Savings Bank. We go through great lengths to protect confidentiality and the security of your account, and urge you to do the same. You agree not to allow anyone to gain access to the Services or to let anyone know your Password used with the Services. You agree to assume responsibility for all transactions initiated through the Services with your St. Casimirs Savings Bank User-ID, up to the limits allowed by applicable law. While St. Casimirs Savings Bank continues to provide our customers with the level of on-line security we believe necessary and appropriate, customers who share their User-IDs and Passwords are giving up the full benefit of our security measures and legal protections to which they may be entitled. No St. Casimirs Savings Bank representative will ever call ask for your Access ID or User Password

BANKING TRANSACTIONS WITH ON-LINE BANKING
Subject to the terms and conditions of this Agreement and Disclosure, you can instruct us to perform the following transactions:
Inquire on account balances
Review account history and transaction details
Transfer funds among your linked checking, savings, money market deposit account, loan and line of credit accounts.
NOTE: Because regulations (NOTE: Reg D) require St. Casimirs Savings Bank to limit pre-authorized transfers (including On-line Banking transfers), the following limitations apply:
Savings or Money Market Deposit Account: You can make no more than six (6) transfers per month out of a passbook account by automatic transfer or On-Line Banking.
Savings Statement Account: You can make no more than six (6) transfers per statement period by pre-authorized or automatic transfer, or by telephone or On-line Banking.
Money Market Deposit Checking Account: You can make no more than six (6) transfers per statement period by pre-authorized or automatic transfer or by telephone or On-line Banking, and no more than three (3) of these may be by check, draft or debit card.
Make payments on your loans at St. Casimirs Savings Bank.
New services may be introduced for On-line Banking from time to time. St. Casimirs Savings Bank will notify you of the existence of these new services. By using these services when they become available, you agree to be bound by the rules that will be made available to you concerning these services.
When you request certain Transactions (e.g., Scheduled Transfers as described below), you will select a date for us to initiate the transaction (Transaction Date). When you initiate a Transaction without selecting a date (Express Transfer as described below), the effective Transaction Date is generally considered to be at the time the transaction is initiated. However, in either case, if the Transaction Date you select is not a Business Day (a Sunday or holiday) or if you do not complete your request by any cut-off time specified in this Agreement and Disclosure for the type of transaction at issue, the effective Transaction Date is deemed to be the next Business Day. Sufficient funds must be available on the effective Transaction Date and will be deducted from the specified account on the effective Transaction Date. Transfers may be processed in two different timing modes as follows:
Express Transfer. When you request an Express Transfer or One Time Transfer through St. Casimirs Savings Bank's Personal Online Banking, the Transaction Date is the Business day when you make the request. Today transactions cannot be cancelled for any reason once your St. Casimirs Savings Bank's Personal Online Banking session is ended, whether voluntarily or not, as funds are immediately deducted from the specified account. Scheduled Transfer. If you designate a Transaction as a Scheduled transaction through St. Casimirs Savings Bank's Personal Online Banking's Scheduled Transfer function, you may designate a date up to 364 days in advance of the Transaction Date. You may be set up Scheduled Transfers to occur Weekly, Bi-Weekly (every other week), Monthly, Bi-Monthly (every other month), Quarterly or Semi-Annually. If you designate a Transaction as a recurring transaction through St. Casimirs Savings Bank's Personal Online Banking's Scheduled Transfer function you will designate a Start date. Recurring transactions may be cancelled or changed (e.g., "Skipped") Once a Scheduled Transfer is established, funds are moved between designated accounts on the date specified. Changes can be made to a scheduled transfer until 8:30 PM CST on the day before the scheduled date of the transfer. Changes cannot be made to a transfer on the date it is scheduled to occur. Attempting to change a transfer on its scheduled date may result in additional transfers.
You may only transfer, or make payments from, funds that are available in your account(s). If any of your qualifying accounts are money market deposit accounts or savings accounts, certain types of withdrawals from those accounts, including payments and transfers, are limited to a total of no more than 6 in any monthly statement period. Withdrawals covered by this limitation are those made by means of online Transactions, pre-authorized or automatic transfers and payments, or telephone agreement. Furthermore, a total of only 3 such withdrawals may be made by check, draft, debit card, or similar order payable to third parties. Exceeding these transaction limits may result in our changing your account to a regular checking account. You also agree to the terms and conditions that you received when you opened your account; you can request this information at any time by contacting the Bank.
Online Stop Payments
Subject to certain limitations, you may request the Bank to stop payment on any check or other item drawn on electronic transfers affecting your account (collectively Items), whether drawn by you or any other Account Owner. A fee is charged for this service. The online stop payment request will be effective if the Bank receives the request at such time and in such manner as to afford the Bank a reasonable opportunity to act upon the request. A stop payment request may be given online and in real time via St. Casimirs Savings Bank's Personal Online Banking using the Add Stop Payment function. The cut-off time for same-day processing of such requests is
While Retail Internet Banking allows you to place a check stop payment on an account, it is your responsibility to verify whether the check has cleared the bank before you set up a stop payment. If the check has already cleared the bank, contact a bank representative and do not place the stop payment. If you place the stop pay knowing the check has already cleared, it will not be honored and fees may apply.
If the check has not cleared the bank, follow the procedure below for placing a stop payment.
Stop payments will remain on the account for 180 days.
A fee may apply for placing a stop payment; please refer to the fee disclosure provided when you opened your account or subsequent updated fee schedule.
In the case of payments you have arranged to be regularly made from your accounts, oral or written notice must be made in time for us to receive your request at least three business days before the next payment is scheduled to be made. The Bank will require you to provide the exact amount (or range of amounts), the check number (or range of numbers), together with the name of the payee for each Item or range of Items. Accuracy is essential since online stop payment orders are processed on the basis of precise information. If you enter incorrect information, the Bank will not be responsible for failing to stop payment on the Item. An online stop payment order becomes effective when we confirm its receipt and have verified that the Item or transaction has not been paid by us. You may only stop payment on a check you have written. You may not stop payment on a check for which a cashier's/official check was issued. In addition, you may not stop payment on checks governed by a separate agreement, such as a check guaranty agreement. Further, you may not stop payment on a check after acceptance of the check by the Bank. You should be aware that while payment of an Item may be stopped, you may remain liable to any person, including the Bank, who is a holder of the Item despite the online stop payment order. The validity and duration of online stop payment orders are subject to applicable state law. Online stop payment orders on checks and ACH (Automated Clearing House) items are good for 180 days (unless renewed or stated otherwise). You will subsequently be mailed a confirmation of the online stop payment request. You need to verify all information in the confirmation and only contact us if there is a discrepancy. You agree to indemnify, defend and hold the Bank harmless from any loss, expense, and cost incurred as a result of stopping payment on an Item, other than losses or costs arising out of our failure to act in good faith or with ordinary care. If you issue a replacement Item, you are responsible for reviewing the prior statements to determine if the original Item has been paid. The Bank will only review its records for transactions since your last statement date. The Bank will not be responsible for any loss incurred by you if you issue a replacement Item for any check on which you stopped payment if payment of the original Item was reflected on a previous bank statement. The provisions of this section shall survive termination of this Agreement and Disclosure.
You will continue to receive your regular account statement either monthly or quarterly, depending on the type of account.
On-line banking transaction will post in your passbook the next time you present it for transactions or updating.
IF YOUR STATEMENT SHOWS TRANSFERS THAT YOU DID NOT MAKE

If you do not notify St. Casimirs Savings Bank within sixty (60) days after the statement was mailed to you, you may not recover any money lost after the sixty (60) days which would not have been lost if St. Casimirs Savings Bank had been notified in time.
ERRORS AND QUESTIONS
Your St. Casimirs Savings Bank On-line Banking or Bill Payment transactions and transfers will be indicated on the monthly or quarterly statements we provide to you for each account. You agree to notify us promptly if you change your address or if you believe there are any errors or unauthorized transactions on any statements, or statement information.
In case of errors or questions, you may Telephone us at (410) 276-0894 during business hours or write us at St. Casimirs Savings Bank, >2703 Foster Ave, Baltimore, MD 21224 as soon as you can if you think your statement is wrong or if you need more information about a transfer listed on the statement.
We must hear from you at the specified telephone number or address no later than sixty (60) calendar days after we sent you the first statement on which the problem or error appeared. We will need:
Your name and account number
A description of the error or the transfer in question, and an explanation concerning why you believe it is an error or need more information.
The dollar amount of the suspected error
The date on which it occurred
If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days. We will determine whether an error occurred within 10 business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your account within 10 business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account.
For errors involving new accounts (during the first 30 days), point-of-sale, or foreign-initiated transactions, we may take up to 90 days to investigate your complaint or question. For new accounts, we may take up to 20 business days to credit your account for the amount you think is in error. We will tell you the results within three business days after completing our investigation.
If we determined that no error occurred, we will send you a written notice within three (3) Business Days. You may request copies of the documents that were used in the investigation.
You agree that St. Casimirs Savings Bank may respond to you by e-mail with regard to any claim of unauthorized electronic fund transfer related to the Service. Any such electronic mail sent to you by St. Casimirs Savings Bank shall be considered received within three (3) Business Days of the date sent by St. Casimirs Savings Bank, regardless of whether or not you sign on to the Service within that time frame.
YOUR LIABILITY & RESPONSIBILITIES
Liability of Consumer for Unauthorized Use, Transactions, Loss, or Theft of Your St. Casimirs Savings Bank Personal Online Banking Access ID and/or Password
You must notify the Bank immediately if you believe any of your Accounts have been accessed or your Password has become known to an unauthorized person. Telephoning is the best way of keeping possible losses to a minimum. If you suggest that an unauthorized transfer or payment may have occurred, you may be required to sign an affidavit.
You could lose all the money plus any available overdraft line of credit, if any, in your deposit account(s) accessed through St. Casimirs Savings Bank's Personal Online Banking if you don't inform the Bank that your Password has become known to an unauthorized person. If you tell the Bank within two business days after you learn of the loss or theft, you can lose no more than $50 if an unauthorized person used your Password to access St. Casimirs Savings Bank's Personal Online Banking without your permission. If you do not tell the Bank within two banking days after you have learned that your Password has become known to an unauthorized person, and the Bank can prove that it could have stopped someone from using your Password without permission if you had told the Bank, you could be liable for as much as $500.If your statement shows electronic funds transfers that you did not make, you must notify the Bank immediately. We may require you to provide your complaint in the form of an affidavit. If you do not tell us within 60 days after the statement was mailed, you may not get back any money you lost after the 60 days if we can prove that the Bank could have stopped someone from taking the money if you had told us in time.
If you believe your St. Casimirs Savings Bank Personal Online Banking Access ID and/or password, or other means of access have been lost or stolen, or that someone has used them without your authorization, contact the Bank immediately. You are liable for all transactions that you or anyone you authorize makes.
If you have given someone your St. Casimirs Savings Bank Personal Online Banking number and password or other means of access and want to terminate that person's authority, you must change your Access ID and password or other means of access or take additional steps to prevent further access by such person. You are responsible for all transactions made by anyone on your accounts with your Password, including unauthorized transactions, subject to limitations of applicable law. Legal limitations on your liability for unauthorized transactions, if applicable, are summarized in this document.
Other Conditions and Termination
You are responsible for complying with all terms of this Agreement and Disclosure and the regulations governing the deposit accounts which you access using St. Casimirs Savings Bank's Personal Online Banking. The regulations governing your deposit account are set forth in terms and conditions and disclosure documents you received at account opening, a copy of which is available from any branch location or by calling the Bank. The Bank can terminate your St. Casimirs Savings Bank Personal Online Banking privileges without notice at any time. You may also terminate your St. Casimirs Savings Bank Personal Online Banking privileges at any time by putting your request in writing and sending it to the address listed at the end of this Agreement and Disclosure. Termination will be effective not later than five Business Days after we initiate the termination procedure or you notify us of your termination. In all cases, termination by you or us will not affect your liability under this Agreement and Disclosure for transactions initiated through the use of St. Casimirs Savings Bank's Personal Online Banking and associated fees. Also, regardless of who terminates your St. Casimirs Savings Bank Personal Online Banking privileges, any Future or Recurring transactions with a Scheduled Date which occurs after the effective date of termination will be automatically cancelled and will not be made.
Unless specifically provided otherwise in the next sentence, the disclosures of this Section, Liability for failure to complete any payment or transfer exceeds the credit limit of any account, (2) and (3) above, and Errors & Questions, and the rights and obligations contained therein, apply only to "Regulation E Transactions," which are transactions governed by the Federal Electronic Funds Transfer Act and Federal Reserve Board Regulation E, made by a natural person whose accounts were established for personal, family or household purposes. For all non-Regulation E Transactions, our duties and responsibilities are limited to those described in this Agreement. We will exercise reasonable and ordinary care in performing our obligations under this Agreement and will be responsible for any loss you sustain only to the extent such loss is caused by our gross negligence or willful misconduct and as otherwise required by the Maryland Uniform Commercial Code, Article 4A, and federal law. Under no circumstances will we be responsible for any liability, loss or damage resulting from any delay in the performance of or failure to perform our obligations under this Agreement which is caused by any: act of God, fire or other catastrophe; electrical or computer (hardware or software) failure or interruption; or, without limiting the generality of the foregoing, any other cause beyond our control. We are not liable for any actual or direct loss arising out of mistakes, omissions, interruption, delays, errors, or defects in transmissions of data or other uses of the St. Casimirs Savings Bank's Personal Online Banking Services. ST. CASIMIRS SAVINGS BANK PERSONAL ONLINE BANKING SERVICES ARE PROVIDED "AS IS". THERE IS NO WARRANTY OF MERCHANTABILITY, NO WARRANTY OF FITNESS FOR A PARTICULAR USE, AND NO OTHER WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, REGARDING THE ST. CASIMIRS SAVINGS BANK PERSONAL ONLINE BANKING SERVICES. YOU ASSUME ALL RISKS OF THE USE, RESULTS AND PERFORMANCE OF THE ST. CASIMIRS SAVINGS BANK PERSONAL ONLINE BANKING SERVICES. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE OR DATA, WHETHER IN AN ACTION IN CONTRACT, TORT, PRODUCT LIABILITY, STATUTE OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. WE WILL NOT BE LIABLE FOR DIRECT DAMAGES CAUSED BY LATE TRANSMISSION, PRODUCT DEFECT, OR ANY OTHER CAUSE, EXCEPT AS EXPRESSLY PROVIDED FOR IN THIS AGREEMENT. ANY LIABILITY WE MAY HAVE (WHETHER IN CONTRACT, TORT, OR OTHERWISE) WILL NOT EXCEED THE AMOUNT YOU PAID US UNDER THIS AGREEMENT FOR THE 30 CALENDAR DAYS PRIOR TO THE TIME WE INCURRED THE LIABILITY.
LIMIT OF ST. CASIMIRS SAVINGS BANK'S LIABILITY & RESPONSIBILITY
St. Casimirs Savings Bank agrees to make reasonable efforts to ensure full performance of On-line Banking. St. Casimirs Savings Bank will be responsible for acting only on those instructions sent through On-line Banking which are actually received and cannot assume responsibility for circumstances over which the bank has no direct control. This includes but not limited to, the failure or malfunctions in communication facilities, which may affect the accuracy or timeliness of messages you send. St. Casimirs Savings Bank is not responsible for any losses should you give incorrect instructions, or if your payment instructions are not given sufficiently in advance to allow for timely payment or delays in mail service.
Any information you receive from St. Casimirs Savings Bank is believed to be reliable. However, it can only be provided on a best-efforts basis for your convenience and is not guaranteed. St. Casimirs Savings Bank is not liable for any deficiencies in the accuracy, completeness, availability, or timeliness of such information, or for any investment or other decision made using this information.
St. Casimirs Savings Bank is not responsible for any fees incurred for Internet access, or for any computer virus or related problems that may be attributable to services provided by any Internet access service provider.
You are responsible for obtaining, installing, maintaining, and operating all computer hardware and software necessary for performing On-line Banking. St. Casimirs Savings Bank will not be responsible for any errors or failures from the malfunction or failure of your hardware or software.
The limit of St. Casimirs Savings Bank's liability shall be as expressly set forth herein. Under no circumstances will St. Casimirs Savings Bank be liable in contract, tort, or otherwise for any special, incidental, or consequential damages, whether or not foreseeable. By consenting to use the Services, you agree to waive any and all right to any of the aforesaid, and you acknowledge that the limit of your remedy is as otherwise expressly set forth herein.
St. Casimirs Savings Bank will be responsible for your actual losses if they were directly caused by our failure to:
Complete an Electronic Funds Transfer as properly requested
Cancel an Electronic Funds Transfer as properly requested.
However, we will NOT be responsible for your losses if:
Through no fault of St. Casimirs Savings Bank, you do not have enough money in your account to make the transfer, if the account has been closed, is not in good standing, or if we reverse a payment or transfer because of insufficient funds. OR;
Through no fault of St. Casimirs Savings Bank, the transaction would have caused you to exceed your available credit, OR;
Circumstances beyond our control (e.g., fire, flood, power outage, mail delivery delays, equipment or technical failure or breakdown) prevent the transfer, despite reasonable precautions that we have taken, OR;
Your equipment or ours was not working properly and the breakdown should have been apparent to you when you attempted to conduct the transaction, OR;
There is a hold on your account, or if access to your account is blocked in accordance with banking policy.
Your funds in the account from which a payment or transfer is to be made is subject to legal process or other claim that restricts the transaction, OR;
Your transfer authorization terminates by operation of law, OR;
You believe someone has accessed your accounts without your permission and you fail to notify St. Casimirs Savings Bank immediately, OR;
You have not properly followed the scheduling instructions, included in this Agreement, to make a transfer or the Payee refuses the Service, OR;
You have not given us complete, correct or current account numbers or identifying information so that we can properly credit your account or otherwise complete the transaction, OR;
For the failure of any payee to correctly account for or credit the payment in a timely manner, OR;
We have received incomplete or inaccurate information from you or a third party involving the account or transfer, OR;
You do not properly follow our instructions or if you provide us with wrong or inaccurate information, or fail to correct or tell us about any inaccuracy of which you are aware, OR;
You do not instruct us soon enough for your payment or transfer to be received and credited by the time it's due, OR;
The circumstances or persons beyond our control prevent, delay, intercept or alter the transaction, despite reasonable precautions that we have taken, OR;
the transaction would exceed one of the limits established in this Agreement and Disclosure, OR;
For changes to the payee's address or account number (unless you have advised us of the change within three (3) Business Days in advance), OR;
We have a reasonable basis for believing that unauthorized use of your Password or account has occurred or may be occurring, or if you default under agreement with us, or if we or you terminate this Agreement, OR;
You default under this Agreement, the Deposit Account Agreement, a credit agreement, or any other any agreement with us or if you or the Bank terminates this Agreement and Disclosure, OR;
There may be other exceptions stated in this agreement and in other agreements with you. In no event shall we be liable for damages in excess of your actual loss due to our failure to complete a transfer, and we will not be liable for any incidental or consequential damages.
If any of the circumstances listed above shall occur, we shall assist you with reasonable efforts in taking appropriate corrective action to reprocess the transactions that may not have been completed or to correct incorrect transactions that have been processed.
ELECTRONIC MAIL (EMAIL)
If you send St. Casimirs Savings Bank an electronic mail message through the Service, St. Casimirs Savings Bank will be deemed to have received it on the following Business Day. Emails will be answered within a reasonable time frame.
You should not rely on electronic mail if you need to communicate with St. Casimirs Savings Bank immediately (e.g., if you need to report an unauthorized transaction from one of your accounts, or if you need to stop a payment that is scheduled to occur).
You agree that St. Casimirs Savings Bank may respond to you by electronic mail with regard to any matter related to the Service, including responding to any claim of unauthorized electronic funds transfer that you make. Any such electronic mail sent to you by St. Casimirs Savings Bank shall be considered received within three (3) days of the date sent by St. Casimirs Savings Bank, regardless of whether or not you sign on to the Service within that time frame.
Internet banking alerts allows you to set up automated alert events based on your own criteria to be alerted upon. Alerts may be sent via email or in an online message box within Internet banking, or both. Email alerts will be sent to the email address you provide in creating the alert.
The bank may add or remove types of alerts from time to time.
If you change your email address you are responsible for changing this in the alerts you have already set up.
You agree that alerts may be delayed or prevented for a variety of reasons.
We do not guarantee the delivery or validity of the contents of any alert.
You agree that we shall not be liable for any delays, delivery failure or misdirected delivery of any alert.
You agree that we shall not be liable for any actions taken or not taken by you or anyone else in reliance of an alert.
The bank will never include your password or full account number in an email alert, however you understand that alerts may include your name and some information about your accounts.
Unfulfilled events (events that do not happen) will only remain on the system for 999 days. You will not be notified when they are removed.
Distributed events (events that have happened and have been viewed) will remain on the system for 30 days.
In addition to this Agreement, you and St. Casimirs Savings Bank agree to be bound by and comply with the requirements of the agreements applicable to each of your On-line Accounts. Your use of the On-line Banking service or the Bill Payment Service is your acknowledgment that you have received these agreements and intend to be bound by them. You should review other disclosures received by you when you open your accounts at St. Casimirs Savings Bank, including the charges that may be imposed for electronic funds transfers or the right to make transfers listed in the fee schedules accompanying those disclosures and the fee schedule at the end of this Agreement. We will automatically deduct any fees related to this Service from your Bill Pay Account each month. All terms and conditions of the disclosures provided to you at account opening, including but not limited to, the Truth in Savings, Regulation E Disclosure, Depositor's Agreement and Terms and Conditions apply to this Service.
MODIFICATIONS TO THIS AGREEMENT
St. Casimirs Savings Bank may modify the terms and conditions applicable to either Service from time to time upon mailing or delivering a notice of the modifications to you at the address shown on our account records, and the revised terms and conditions shall be effective at the earliest date allowed by applicable law.
We will mail or deliver a written notice to you at least 30 days before the effective date of any change in a term or condition disclosed in this Agreement and Disclosure, if the change would result in increased fees or charges, increased liability for you, fewer types of available funds transfers or stricter limitations on the frequency or dollar amounts of transfers, unless prior notice is excused by law. In all other cases, we will provide notice of changes in the manner we deem appropriate, including email.
We may send any notice to you via electronic mail and you will have been deemed to have received it three (3) days after it is sent. We reserve the right to terminate this Agreement and your use of the Services in whole or in part at any time without prior notice.

The Bank will disclose information to third parties about your account and transactions you make:
when it is necessary for verifying or completing transactions, or resolving a problem relating to a transaction;
in order to verify the existence and the condition of your account for a third party, such as a credit bureau or merchant;
in order to comply with government agency or court orders;
if you give written (including email) permission; or
as otherwise permitted in the Bank's deposit agreements and disclosures or as otherwise required or permitted by law, or government regulations.

INACTIVITY / TERMINATION
You are responsible for complying with all the terms of this Agreement and with the terms of the agreement governing the deposit accounts which you access using electronic banking services. We can terminate your On-line Banking privileges (including the Bill Payment Service) under this Agreement without notice to you for any reason; or if you do not pay any fee required by this Agreement when due, if you do not comply with the Agreement governing your deposit or loan accounts, or your accounts are not maintained in good standing. We will promptly notify you if we terminate this Agreement or your use of the services for any other reason.
If you are not paying a monthly service charge for the Service, we may convert your account to inactive status if you do not sign on to the Service or have any transaction scheduled through the Service during any consecutive 6 months period. If your account is considered inactive, you must reenroll to have the Service activated before you will be able to use the on-line banking or schedule any transaction through the Service.
To cancel the On-line Banking and/or Bill Payment Service, you must notify St. Casimirs Savings Bank. Your notification should include your name, address and the effective date to stop the service(s). When Bill Payment is terminated, any pre-scheduled bill payments made through On-line Banking will also be terminated. Your final charge for the Bill Payment Service will be assessed at the end of your statement cycle. You may notify St. Casimirs Savings Bank by one of the following methods:

This Agreement is governed by the laws of the State of Maryland and applicable federal law(s).
St. Casimirs Savings Bank offers the benefits and convenience of the On-line Banking service to you at no monthly charge. Account research, stop payment charges and Bill Pay Services will be assessed at the rates published in St. Casimirs Savings Bank's Miscellaneous Schedule Fees Brochure and deducted from your Bill Pay Account or another account you hold at St. Casimirs Savings Bank.
These fees are subject to change. St. Casimirs Savings Bank will notify you in writing regarding any fee changes at least thirty (30) days in advance of the effective date of these changes.
